⚖️

A Power of Attorney (POA) is one of the most important legal documents for NRI families. It allows you to manage your parents' affairs when you can't be physically present.

Types of Power of Attorney

General Power of Attorney (GPA) Gives broad authority to act on behalf of your parents in multiple matters — property, banking, legal proceedings. Useful but can be risky if misused.

Special Power of Attorney (SPA) Limited to specific tasks — selling a property, operating a bank account, or handling a legal case. Safer and more commonly recommended.

Medical Power of Attorney Authorizes someone to make healthcare decisions when your parent cannot. Critical for emergency situations.

How to Create a POA from Abroad

  1. **Draft the document**: Hire a lawyer in India familiar with NRI matters
  2. **Get it notarized**: At the nearest Indian consulate or embassy
  3. **Apostille/Attestation**: Required for international validity
  4. **Register in India**: At the Sub-Registrar's office where it will be used
  5. **Send originals**: Courier registered copies to India

Documents Required

  • Passport copies (yours and your parents')
  • Aadhaar card copies
  • Address proof of property (if property-related)
  • Two passport-size photographs
  • The POA document itself

Cost Breakdown

  • Lawyer fees: ₹5,000-₹15,000
  • Notarization at consulate: $20-$50
  • Apostille: Varies by country
  • Registration in India: ₹1,000-₹5,000
  • Stamp duty: Varies by state (2-5% for GPA)

Common Mistakes to Avoid

  • Making the POA too broad (use SPA when possible)
  • Not registering it (unregistered POA has limited validity)
  • Not including specific powers you need
  • Forgetting to set an expiry date
  • Not having a backup POA holder

When Your Parents Can't Sign

If a parent is mentally incapacitated, you'll need to apply for legal guardianship through a district court. This takes 3-6 months and requires medical certificates.

Start the POA process now while your parents are healthy and can give informed consent. Don't wait for an emergency.
